CapeNature seeks to appoint a professional, competent, dynamic, innovative, and energetic candidate to manage, lead and coordinate the legal services unit within the Strategy Governance and Risk portfolio of the entity. The ideal candidate should have well developed interpersonal, communication and writing skills and have a high level of professionalism. The Legal Manager will work in collaboration with the legal advisors within the entity and shall report directly to the General Manager: Strategy, Governance and Risk.
The incumbent will be highly motivated and shall take full responsibility for the effective management of the legal services unit. In additional to drafting, reviewing and managing legal processes related to contracts and all matters ancillary thereto, the incumbent will also be required to provide legal advice and guidance to the entity, ensure policies and procedures within the entity are up to date and enforced, over-seeing the legal processes relating to Land, Stewardship and Litigation.
Review and drafting contracts and day-to day contract management by implementation of the entity’s Contract Management Framework.
Ensure that the Contracts Management Framework of the entity remains relevant and aligned to National and Provincial standards for Public Entities.
Taking instructions and drafting agreements, addendums, leases, concessions, memorandums of understanding and generally to facilitate contract negotiations on behalf of the entity
Ensure that all contractual and legal disputes are dealt with as effectively as possible so as to minimise any risk to the entity and with the entity’s best interest always being paramount.
Drafting and/or attending to the award of tenders to successful bidders (flowing from SCM tender process) and coordinating the contract lifecycle from inception to finalization.
Responsible for identifying legal risk and ensuring that same is managed effectively.
Legislation, Legal Advice and Opinion
Working closely with the GM: SGR to understand the Entity’s strategy and to identify potential risks or issues.
Provide support and guidance to internal stakeholders on policy development.
Provide legal advisory services to all internal stakeholders across the entity and ensure sound and informed advice and opinion is provided.
Identify legislation and/or amendments to legislation which has a direct impact on the entity and ensure compliance.
Ensure the efficient and effective administration and filing systems are in place for hosting of contractual and all legal documents.
Ensure that contracts registers and repository of all contracts active within the entity remain updated and are accurate and reliable.
Strategic Leadership and Management
Assist in documenting policies and processes to ensure the effective operation of the entity.
Manage, lead and coordinate the Land, Stewardship and Litigation portfolios within the Legal Services unit.
Ensure all reporting emanating from legal services is accurate and reliable.
LLB with a minimum of 5 years’ post articles experience
An admitted attorney
Sound knowledge of all relevant Environment legislation, Public Finance Management Act and Treasury Regulations/instructions
Ability to interpret and apply legislation
Attention to detail and high degree of accuracy, deadline driven and able to work under pressure
Strong legal writing and research skills
A valid code 8 driver’s licence
